  1. Definitions
    1. The following expressions shall have the following meanings:
    2. "Agency" means Swedish Nannies. The agency does not employ a candidate directly or indirectly. It only acts as an introductory agent.
    3. "Client" means any parent, or nominated third party representing the parent, in contact with the agency, verbally or written, requiring a suitable candidate to provide child care services.
    4. "Candidate" means any individual introduced to the client by the agency to provide child care services.
  2. Registration
    1. By providing the agency with a completed registration form clients and candidates are deemed to have accepted the terms and conditions set out here.
    2. The terms and conditions shall apply to and govern all agreements or contracts made between the client or candidate, either verbally or written.
  3. Nationalities
    1. Swedish Nannies accepts candidates of all nationalities to register with us.
  4. Fees
    1. There is no registration fee to be paid by the client or candidate to use the agency's service.
    2. The agency charges the client a one off fee once the candidate has accepted an offer made either verbally or written by the client.
    3. Current fees are: £2500 for a nanny placement and £750 for an au pair placement. The agency reserves the right to change the fees at any time. However, the fee will remain fixed for individual clients from the point at which the client first requests a candidate from the agency and until a suitable candidate is employed by the client, or until the client withdraws their request for a candidate.
    4. The fee is payable to the agency via bank transfer within 14 days of the invoice date and must be paid in full before the candidate commences employment.
    5. If the candidate withdraws from an accepted offer made by the client before the agreed start date no fee will be charged to the client.
    6. The agency reserves the right to charge the client a surcharge of 10% on all invoices which have not been paid when due in accordance with these terms and conditions. Unpaid invoices will be passed along to a debt collection company appointed by the agency which may result in additional charges to the client.
  5. Contract
    1. It is the responsibility of the client to provide the candidate with an employment contract. This must specify the client’s requirements, the length of employment, salary being paid, working hours and details of the work the candidate is to carry out.
    2. The employment contract is between the client and the candidate. The agency will not be held liable for its content.
    3. The agency can provide the client with an employment contract template if required. However, the agency will not be held liable or responsible for any mistakes and/or errors made in the provided template. We recommend consulting a solicitor or seeking guidance from a Citizen Advice Bureau before signing any contract.
    4. The client agrees to provide the agency with a signed copy of the employment contract between the client and candidate no later than 7 days after it’s been signed.
  6. Swedish Nannies Promise
    1. Our fee is backed by our Swedish Nannies Promise. If either the client or the candidate terminates the contract within 14 days of the contract start date the agency will refund the client any fee paid or provide another match for free.
    2. The agency reserves the right to not give the client a refund or provide another match for free should either the client or candidate terminate the employment contract after 14 days of the contract start date.
    3. Further to clause 6.2, the agency reserves the right not to give a refund or provide another match for free should the client deemed to have been verbally and/or physically abusive towards a candidate or an employee of the agency.
    4. To invoke the Swedish Nannies Promise the client must contact the agency within 14 days of the contract start date, explain the issue and provide proof of employment termination.
    5. Should a refund be requested and granted, it will be paid in full by the agency via bank transfer to the client within 30 days of receiving proof of employment termination. The maximum refundable amount will not be greater than the original fee paid.
    6. Should a replacement candidate be required, the agency will start a new search. If a suitable candidate cannot be found the client will receive a full refund of the original fee paid.
    7. The agency reserves the right to refuse a replacement if we believe our Swedish Nannies Promise is being abused by continually invoking this policy. In this case the client will receive a full refund of the original fee paid and no further replacement will be sought.
  7. Client's Obligation
    1. All information provided to the agency by the client shall be true and accurate.
    2. Before the agency can present the client with suitable candidates the client must complete the agency’s online registration form.
    3. The agency will obtain and verify documentation, including but not limited to police check, first aid certificate and references from each candidate. However, it is recommended that the client also undertakes appropriate checks as to the suitability of the candidate before offering employment.
    4. It is the client’s responsibility to become an employer and to make sure that all relevant employment laws are being met.
    5. The client is responsible for paying the candidate’s wages, tax and national insurance contribution and all other expenses that may occur.
    6. It is the client’s responsibility to have adequate insurance in place for the whole period in which the candidate is employed. It is a legal requirement that all employers have a employers liability insurance in place. The agency recommends Enable Insurance Services However, clients should consult their solicitor regarding the most appropriate insurance cover for them.
    7. It is the client's responsibility to make sure that if they require the candidate to drive a vehicle whilst working that the vehicle is adequately insured and legal to drive on public roads. It is also the client's responsibility to make sure that the candidate is a competent driver and holds a valid, clean driver’s license to drive in the United Kingdom.
    8. The client agrees to notify the agency immediately once the candidate has accepted an offer made by the client verbally or written and provide the agency with all relevant details.
    9. Following the introduction of a candidate to a client, the client shall not employ or independently contract the introduced candidate in a way in which to avoid paying the agency its fee as set out in 4.2 and 4.3. The restriction is valid for the contractual period between the client and candidate and shall apply for a period of 6 months either following the termination of a candidate's contract, or 6 months from the point at which the candidate is introduced to the client but not employed.
    10. Further to clause 8.9, should the client refer the candidate to others looking to employ the candidate for a similar service and the candidate gains employment under this person, the agency reserves the right to charge the client with the full client/ candidate fee. This clause will remain valid for a period of 6 months, from the point of the initial client/ candidate introduction or, if the client employs the candidate, for a 6 month period following the termination of the candidate’s contract with the client.
    11. The restriction contained in clause 8.9 and 8.10 are reasonable in all circumstances and are no more than are required to protect the legitimate business interests of the agency.
    12. The agency reserves the right to terminate the contract with the client at any time if the client is in breach of their obligations under this agreement. Any delay by the agency in exercising its right to terminate shall not constitute a waiver thereof.
  8. Candidate's Obligation
    1. All information given to the agency by the candidate shall be true and accurate.
    2. The agency only acts as an introductory agent and will not employ any candidates directly or indirectly.
    3. Before the agency can present a candidates to its clients the candidate must provide the agency with all the required documentation. This includes but are not limited to our online registration form, a recent police check (no older than 3 months), a valid first aid certificate (no older than 3 years), a minimum of two verifiable reference checks and a photograph.
    4. It is the candidate’s responsibility to pay for their own police check, first aid certificate, travel costs and any other expenses that may be incurred.
    5. The candidate agrees to notify the agency immediately should the client try to bypass the agency and employ the candidate directly.
    6. The candidate agrees not to disclose any personal contact information to the client at the interview stage which could lead to the client bypassing the agency and contact the candidate directly. This includes but are not limited to telephone numbers, emails and postal addresses.
    7. The candidate is responsible for negotiating their own wages and all other working conditions, as well as obtain a signed employment contract from the client prior to commencing employment. The agency can not be held liable for any employment contract between the candidate and the client.
    8. Candidates are strongly recommended to take out adequate public liability insurance before commencing employment. The agency recommends Nanny Insure.
    9. Candidates are under no obligation to remain with the agency and can at any point withdraw their application. Candidates who do not sign up with the agency may not use Swedish Nannies name and reputation to gain employment elsewhere.
    10. The agency reserves the right to terminate the contract with the candidate at any time if the candidate is in breach of their obligation under this agreement. Any delay by the agency in exercising its rights to terminate shall not constitute a waiver thereof.
  9. Confidentiality
    1. All information given to the agency shall be kept confidential between the parties. The client and candidate agree to the agency passing information to government bodies, should the agency be legally obliged to do so.
    2. The client agrees that information provided by them may be passed to candidates in order to find a suitable match.
    3. The candidates agrees that information provided by them may be passed to clients in order to find a suitable match.
    4. The client agrees that all information passed between the agency and the client regarding a candidate shall be kept confidential and not passed to other persons including other potential clients.
    5. The candidate agrees that all information passed between the agency and the candidate regarding a client shall be kept confidential and not passed to other persons including other potential candidates.
    6. By registering with the agency clients and candidates agrees to occasionally receiving communications from the agency. This will be sent out using the email or postal address stated in the online application form. Clients and candidates can at any point opt out from these communications by contacting the agency.
  10. Website
    1. By using the Swedish Nannies website and service users are deemed to have accepted our terms and conditions.
    2. The agency reserves the right at any point in time to add or to change the terms and conditions without prior notice. All changes will be made available to view on the Swedish Nannies website and a notification of any changes will be posted on the website’s terms and conditions page. By continuing to use the Swedish Nannies website, the user is deemed to have accepted any changes made to the terms and conditions.
  11. Copyright
    1. The copyright, trademarks and all other intellectual property on this website is owned by Swedish Nannies, or a third party that has given its permission for it to be used on this website. This includes but are not limited to website text, logo and images.
    2. Material found on this website must not be used for any commercial purposes, copied, reproduced, reposted, downloaded, printed off or republished in any way or form.
  12. Liability
    1. It is the sole responsibility of the client to determine the suitability of the candidate for the required role.
    2. The agency will under no circumstances be held liable for the candidates conduct before, during or after their employment with the client.
    3. It is always the choice of the client whether to employ a candidate or not.
    4. The agency takes no responsibility for false, or inaccurate information given to the agency by the client or the candidate.
    5. The agency will not accept any liability for damage, death, injury, expenses, theft, loss or costs incurred by, or because of, the client or candidate directly or indirectly.
  13. Governing Laws
    1. These terms and conditions of business are governed by and constructed in all respect in accordance with the law of England and the client and candidate must submit to the exclusive jurisdiction of the courts of England.
